Each justice would be required to publicly release their opinions & disclose how they voted on issues considered on an emergency basis, sometimes referred to as the #ShadowDocket. Such decisions, which have become more common & increasingly controversial in recent years, don’t identify how each justice voted.

It would require the #IRS to initiate an #audit of the justices’ tax returns each year, release the results & make the tax filings public. Nominees to the court would have to disclose 3 yrs of tax returns.

Another measure would allow a two-thirds vote of the court to force a fellow justice to #recuse from a case.

During the rollout, each president would approve justices in the first & third year of their terms.

The bill would also require a ruling by ⅔ of the high court & the circuit courts of appeals, rather than a simple majority, to overturn a #law passed by #Congress. #Wyden said the current court has been too quick to discard #precedent & curtail #rights by narrow majorities.

[ oh & that’s to say nothing of the fact that a #SupremeCourt *Justice* literally just threatened the sitting #President of the #UnitedStates of America. ]

…make no mistake, this is bully talk coming from #Gorsuch & #SCOTUS. The #SupremeCourt has no official capacity or duty to make #laws or enforce them. It is the sole jurisdiction of #Congress to make laws, & thereby create #legislative reform. It is also the power of the #President, as the leader of his #political party, to recommend & advise to his party members in Congress to make laws that he believes would be beneficial to the Republic.

What government is coming after me, Mr. Justice? I am a #law abiding citizen. The only branch of the govt that seems to, at this specific moment, be coming after a good citizen like me & my rights is #SCOTUS… of which you are a member…. So which is it, Mr. #Gorsuch, the *deep-state*… or you…? I would love a ferociously #independent judge & jury of my peers to make decisions, but that is pretty damn difficult when you just made #BRIBERY #LEGAL!

I would not consider #Gorsuch nor the other #Conservative *Justices* my peers. They do not represent any of my #political, #moral, #cultural, or #intellectual #values at all. I also would not consider a Judge that goes & airs his opinion on #FOXNews, like dirty laundry, #independent — not by any meaning of the word.  Furthermore, the line “when the government’s coming after you,” betrays even more political #bias. 

Then #Gorsuch finished with the most cryptic and disconcerting [threat] warning:

“And so I just say, be careful.”

Why not just say, “stand back & stand by?”

Maybe Justice Gorsuch broke into Justice #Kavanaugh’s liquor cabinet, but one wonders what on earth Gorsuch means by “don’t you want a ferociously independent judge & a jury of your peers to make those decisions.”  Certainly, I do.  I do not know what that has to do w/preventing #SCOTUS reform.

“You’re not going to be surprised that I’m not going to get into what is now a political issue during a presidential election year. I don’t think that would be helpful.”

Justice #Gorsuch said this immediately before getting #political & outright god damned #creepy.

Customs & Border Protection records revealed that #ClarenceThomas & his wife, #GinniThomas, took a round trip between Hawaii & New Zealand in Nov 2010 on #HarlanCrow’s private jet. Sen #RonWyden, #Democrat of Oregon, writing to Crow’s lawyer, demanded that he supply more info about the #financial relationship between the 2 men.

Reform, then, is less an effort to restrain the #independence of the #SupremeCourt than it is the beginning of a long battle to restore the independence that was lost when #conservatives seized this branch of our government for their own ends.

#Biden’s proposal is a declaration that #SCOTUS is wrong about the #Constitution, that it has abused its power & influence & that it needs to be checked & balanced. He is, of course, far from the first president to do this — Abraham Lincoln & Franklin Roosevelt come to mind — but he is the first modern #Democratic president to recognize that the court as constituted is a major obstacle to the party’s ability to #govern in accordance w/its popular mandate.

The #Constitution means whatever the #JohnRoberts court says it means, even when that meaning conflicts w/the basic principles of American #democracy.

It is against this backdrop of institutional #dysfunction & #judicial arrogance that President #Biden, fresh from his decision to leave the campaign trail in favor of his vice president, introduced his three-point package of #SupremeCourt reforms.

In just the last term, the Roberts court has rewritten the #14thAmendment to keep Donald #Trump on the presidential ballot as well as radically expanded presidential #power in direct contravention of the history, text & structure of the #Constitution.

We have, in other words, a #corrupt & #lawless court that, led by its #conservative majority, has put itself above the constitutional system as the exclusive arbiter of constitutional meaning.

Watch from the beginning #POTUS #Biden’s remarks in Texas on the 60th anniversary of the #CivilRightsAct. He went off script & it was awesome.
