Nekodojo<p>Farmers Insurance doesn't honor "Small Estate" probate, discriminates against low-income people</p><p>We recently had a death in the family (Tom). He was owed a refund of around $300. </p><p>There is a "normal" probate process which involves a court, and the "going rate" for simple no-frills probate case is around $5000. Luckily in California (and something like 30+ other states) there is a "Small Estate" process which allows you to settle a loved one's estate out of court.</p><p>Apparently Farmers Insurance just... doesn't honor the Small Estate process. At all. It's their "policy". So, rather than taking them to court, we filed a complaint with the California Department of Insurance. If you do not have a Life Will and zero heirs, State probate has title to all your stuff when you die. Even if you have heirs, State Probate can refuse to honor the heirs by holding the estate on a tax question for decades. They wait the heirs out, maybe they die. State gets all the estate.
