“In a separate dissenting opinion, [Justice] Jackson wrote that the court’s decision poses ‘an existential threat to the rule of law’ by allowing the exec branch to ‘violate the Constitution w respect to anyone who has not yet sued.’”

CASA (plaintiff in Maryland #BirthrightCitizenship case) has now filed an amended complaint seeking class certification for similarly situated individuals impacted by #Trump’s #ExecutiveOrder.

Some of the policies that the #Trump administration has tried to bring into effect, only to be blocked by #NationwideInjunctions that remain in force, for now:

— A (redundant) #voter ID #ExecutiveOrder that requires proof of #citizenship

— Federal Funding Freeze that froze trillions of dollars of federal #grants & #loans

— an order by the #Education Dept that demanded that #PublicSchools either eliminate programs promoting #diversity & #equity, or lose their federal #funding.

#Barrett writes that "prohibiting enforcement of the #ExecutiveOrder againast the child of an individual pregnant plaintiff will give that plaintiff complete relief. Her child will not be denied citizenship. Extending the injunction to cover all other similarly situated individuals would not render her relief any more complete."

In addition, #SCOTUS has allowed him to kick transgender #ServiceMembers out of the #military, even as court battles continue. #Trump also signed another #ExecutiveOrder to define the #sexes as only male & female.

#Trump, in an #ExecutiveOrder, said conditions for resolving the #NationalSecurity concerns would be laid out in an agreement, without providing details.

"I additionally find that the threatened impairment to the national security of the United States arising as a result of the Proposed Transaction can be adequately mitigated if the conditions set forth in section 3 of this order are met," #Trump said in the order, which was released by the White House.

Oregon & Washington, which conduct their #elections almost entirely by mail, filed a separate lawsuit over the #ballot deadline, saying the #ExecutiveOrder could disenfranchise voters in their #states. When the lawsuit was filed, Washington Secretary of State Steve Hobbs noted that more than 300,000 ballots in the state arrived after Election Day in 2024.

#Trump has said his #ExecutiveOrder *secures* elections against illegal voting by noncitizens, though multiple studies & investigations in the #states have shown that it’s exceedingly rare & typically a mistake. Casting a ballot as a noncitizen is already against the #law & can result in fines & #deportation if convicted.
